Introduction: These terms of service (the "Terms") govern your use of Enigma (the "Marketplace"), a platform that connects clients with freelancers for the purpose of buying and selling services. By accessing or using the Marketplace, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Marketplace.
Eligibility: To use the Marketplace, you must be at least 18 years old and able to enter into legally binding contracts. If you are under the age of 18, you may not use the Marketplace.
Account Registration: In order to use the Marketplace, you will need to create an account. You agree to provide accurate and complete information when creating your account, and to update your account information as needed to keep it current. You are responsible for maintaining the security of your account, and you may not share your account login information with anyone else.
Services: The Marketplace allows clients to search for and hire freelancers to perform a variety of services. Enigma is not a party to any agreements between clients and freelancers and is not responsible for any services provided by freelancers.
Fees: Enigma charges a fee for the use of the Marketplace. This fee may be a percentage of the total amount paid by the client to the freelancer, or it may be a flat rate. The fee will be clearly disclosed to you before you agree to hire a freelancer through the Marketplace.
Termination: Enigma reserves the right to terminate your account or your access to the Marketplace at any time, for any reason, and without notice.
Disclaimer of Warranties: The Marketplace is provided on an "as is" and "as available" basis. Enigma makes no representations or warranties of any kind, express or implied, as to the operation of the Marketplace or the information, content, materials, or products included on the Marketplace.
Limitation of Liability: Enigma shall not be liable for any damages of any kind arising from the use of the Marketplace, including but not limited to direct, indirect, incidental, punitive, and consequential damages.
Indemnification: You agree to indemnify and hold Enigma and its affiliates, officers, agents, and employees harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the Marketplace, your violation of these Terms, or your violation of any rights of another.
Governing Law: These Terms and your use of the Marketplace will be governed by and construed in accordance with the laws of the State of Romania, without giving effect to any principles of conflicts of law.
Order Reports: Enigma takes reports of any issues or problems with orders very seriously. If you have a problem with an order that you placed through the Marketplace, you may report the issue to Enigma by contacting our customer support team. Enigma will investigate the issue and take any necessary action to resolve the problem.
Native Token: Enigma has its own native token $ENG, which may be used to on the Marketplace. You acknowledge and agree that using the native token to make purchases on the Marketplace does not entitle you to any potential gains or appreciation in value. The value of the native token is subject to market forces and may fluctuate significantly over time. You are solely responsible for any losses or damages that may result from using the native token to make purchases on the Marketplace. You may also choose to make purchases on the Marketplace using other cryptocurrencies, such as Ethereum or USDT, at your discretion.
Use of $ENG: By purchasing or holding the Enigma native cryptocurrency (ENG), you acknowledge and agree that you are solely acquiring ENG for consumptive use in connection with Enigma's platform and not for distribution. You do not expect any economic benefit or profit as an ENG holder, and you are purchasing ENG solely for your own use, not to sell to anyone else. You do not acquire any equity or other ownership interest in Enigma LLC by owning ENG, and you will not portray Enigma as an investment or an opportunity to obtain economic benefit or profit.
Seller Vouching: Enigma does not vouch for the quality, reliability, or legality of any goods or services offered by sellers on the Marketplace. While Enigma may verify the identity of some sellers through a verification process, this does not constitute an endorsement or guarantee of the seller or their products. You are solely responsible for evaluating the suitability of any goods or services offered by sellers on the Marketplace and for conducting your own due diligence before making a purchase. Enigma only vouch for sellers who have been awarded a verified badge, which indicates that the seller has undergone a thorough verification process and has been determined to meet certain standards set by Enigma.
Milestone Deliveries: If you are hiring a freelancer through the Marketplace and agree to pay for services on a milestone basis, you are required to accept each milestone delivery within 7 days of receipt. If you do not accept a milestone delivery within 7 days, you will not be eligible for a refund for that milestone. It is your responsibility to review and accept each milestone delivery in a timely manner, and to communicate any issues or concerns with the freelancer directly. Enigma is not responsible for any delays or problems that may result from your failure to accept a milestone delivery in a timely manner.
NFT Benefits: The benefits of holding an Enigma NFT do not constitute a promise or guarantee of any increase in value. Instead, the benefits of holding an Enigma NFT may include various on-platform perks and privileges, such as discounts, eligibility for airdrops, and other promotions or offers. These benefits may change from time to time at the discretion of Enigma, and Enigma makes no guarantees or warranties regarding the availability or value of any NFT benefits. You are solely responsible for any decision to purchase or hold an Enigma NFT.
